Whereas, all copyrighted content is protected by the Federal Constitution of 1988 and the Copyright Law (Law 9610/98), which protects illustrations, texts and other artistic works by the priority act of publication and use;

Whereas, the company WISSENTECH INTELLECTUAL PROPERTY LTDA is the owner of the trademark:

Wissentech Innovation Agency ®, process no. 919.754.570;

All registered at the National Institute of Industrial Property (INPI), and protected by the Industrial Property Law of May 14, 9.279/96;

elucidates the term of use below:

1. CONDITIONS OF USE

This Term establishes the necessary and/or mandatory conditions for the use of the marks mentioned in the preamble of this document.

The owner of the marks reserves the right to update the Term of Use periodically, at its sole discretion.

2. ELIGIBILITY

In order to agree to access, reproduce and use the intellectual content, the visiting user must read, acknowledge and accept the conditions of this Agreement. The use of the marks for the purposes directed, implies in the full understanding and full acceptance of the conditions provided in this Term of Use.

3. GENERAL CONDITIONS

The visitor of the present electronic site agrees

a) Not to use the content present in the electronic site (wissentech.com.br), as well as in its subdomains or subfolders for commercial purposes without the express consent of its owner;

b) Not use any authorial content available on this electronic site, social networks, materials, whether printed or digital, for their own benefit with the objective of obtaining revenue, even if it involves registering domains, company names or site layout.

4. THIRD PARTY CONTENT AND LINKS

WISSENTECH INTELLECTUAL PROPERTY LTDA has no responsibility for the content, pages, social networks or printed materials related to Third Parties or any other entity cited on this website.

5. TREATMENT OF SENSITIVE DATA

In order to research precedents, evaluate solutions and formalize proposals, WISSENTECH INTELLECTUAL PROPERTY LTDA, in specific cases, needs to collect data and information about the user and his intellectual assets. Therefore, in line with the General Law of Data Protection 13.709 of 14/08/2018, at any time, all users who have their data collected have the right to request a report on the use of sensitive data collected either through this website, by personal service, telephone or online by any partner or employee of WISSENTECH INTELLECTUAL PROPERTY LTDA.

6. LIABILITIES AND PENALTIES

The user who violates the terms of this Terms of Use agrees that he is aware that the misuse and contrary to the Terms of Use infringes Article 189 of the IPL, and may be prosecuted. As quoted below:

“Art. 189. A crime against trademark registration is committed by whoever

I – reproduces, without the authorization of the holder, in whole or in part, a registered mark, or imitates it in a way that may induce confusion; or

II – alters the registered mark of another already affixed to a product placed on the market.

Penalty – detention, from 3 (three) months to 1 (one) year, or a fine.
